The agreement
Holababy is run by [Operator legal name]. By creating an account you agree to these terms and to the Privacy Policy. You must be an adult who can enter a contract where you live. One person, one account.
What Holababy is, and is not
Holababy is a shared log of a baby's day: feeds, diapers, sleep, pumping, medicines, notes, and health entries, with reminders and charts. It is a diary and a memory aid for the adults who care for a baby.
It is not a medical device and gives no medical advice. Nothing it shows replaces a doctor, a nurse, or your own judgment. If a baby is unwell, call a medical professional or your local emergency number; do not rely on the app.
Your account
- Give a real name and an email address you control, and keep them current.
- Keep your password to yourself. Anything done while signed in to your account counts as done by you.
- Tell us at help@holababy.app as soon as you think someone else has used your account.
What you put in
Everything you log belongs to you. You give us only the permission we need to store it, show it to the people you share with, and run the service. We do not use your log for anything else.
You are responsible for what you enter, including information about other people: a co-parent, a carer, or a child in your care. Only share a baby with someone who should see that baby's log, and only invite people whose address you may use. Anyone you give the manager role can invite and remove others, including you.
What you may not do
- Use the service for anyone whose data you have no right to hold.
- Try to reach accounts, babies, or systems that are not yours, or probe the service for weaknesses without asking us first.
- Send abusive or unlawful content, or use the service to harass anyone.
- Run scripts against the service, scrape it, or get around plan limits, rate limits, or the sign-up checks.
- Resell the service or pass your account to someone else.
Plans and payment
- The free plan is free for as long as we offer it. Paid plans are billed by Stripe, monthly or yearly, at the price shown on the pricing page when you choose them, plus any tax that applies.
- Paid plans renew by themselves until you cancel. Cancel any time from the Account page; the plan runs to the end of the period you paid for and does not renew.
- A free trial ends on the date shown when it starts. If you have not chosen a paid plan by then, your account returns to the free plan. Nobody you share with is removed when that happens, but the free plan's limits apply to new sharing.
- Promotion codes are honoured as described when they are issued and may be withdrawn for new customers at any time.
- Payments are not refunded except where the law requires it or we decide to. When we do refund, your plan does not change unless you cancel it.
- If we change a price, we tell you by email at least 30 days before it applies to you. You may cancel before then.
Ending the agreement
You may delete your account at any time from the Account page. The Privacy Policy says what happens to your data when you do. If you break these terms we may suspend or close your account; where we reasonably can, we will warn you first and give you a chance to export your data. We may also stop offering Holababy altogether, with at least 60 days' notice and the export available until the end.
Availability and what we promise
We work to keep Holababy up, fast, and backed up, and we tell you about problems we know of. We do not promise that it will never be down or never lose a record. Keep your own copy of anything you cannot afford to lose; the export is there for that.
To the extent the law allows, the service is provided as it is, and our total liability to you for anything arising from it is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that the law does not let us limit, including for death, personal injury, or fraud.
Changes to these terms
When these terms change, the date at the top changes. If a change reduces your rights or adds obligations, we email you at least 30 days before it takes effect. If you keep using Holababy after that date, the new terms apply; if you do not want them, delete your account before then.
Which law applies
These terms are governed by [governing law]. If you are a consumer, you keep any protection the law of your own country gives you, and you may bring a claim in your own courts.
